Objectives

  • Analyse the concept of breach of contract, the concept of standard of duty and the law’s requirements for proof of breach.
  • Consider the circumstances in which breach of contract confers a right of termination.

Self-help - enforcement of a right (termination) rather than a remedy (damages); express provisions for termination ("termination clauses"), their drafting, exercise and consequences

Assessment

  • 1 x Compulsory Essay (25%)
  • 1 x Exam or 1 x Long Essay (75%)
