Brief Biographical Detail
Terry Carney (LL.B.(Hons), Dip. Crim. (Melb), Ph.D.(Mon)) is Emeritus Professor of Law at the Faculty of Law, University of Sydney, where he was a long-serving Director of Research and past Head of Department. A Fellow of the Australian Academy of Law, he is a past President (2005-2007) of the International Academy of Law and Mental Health, and chaired Commonwealth bodies such as the National Advisory Council on Social Welfare and of the Board of the Institute of Family Studies, along with various State enquiries on child welfare, adult guardianship and health law.
The author of nearly a dozen books/monographs and over a hundred and sixty academic papers, his latest book is Carney, Tait, Perry, Beaupert & Vernon, Australian Mental Health Tribunals: ‘Space’ for fairness, freedom, protection & treatment?, (Sydney: Themis/NSW Law Foundation, 2011). Other recent books include Managing Anorexia Nervosa: Clinical, Legal & Social Perspectives on Involuntary Treatment (New York: Nova Science, 2006); Social Security Law and Policy (Sydney: Federation press, 2006) and Bennett, B., Carney, T., & Karpin, I. (eds), The Brave New World of Health. Federation Press, 2008.
His book Carney & Ramia, From Rights to Management: Contract, new public management and employment services. Kluwer Law International, 2002, 1-217 examined transformations of social rights in the area of social security and employment, as wrought by privatization and market forces. These and other works apply citizenship theory and ‘contractualism’ to analyse law and policy for vulnerable groups such as the unemployed, children, the aged and disabled. Earlier works include Carney and Tait An Experiment in Popular Justice: Adult guardianship in Australia. (1997, Federation Press);
Currently he is working on a number of Australian Research Council funded studies (1) ‘Legal and Ethical Preparedness for Pandemic Influenza’ [CI’s Bennett & Carney]; (2) ‘Juror Confidence in Justice: Democratic participation or deference to authority? [CI’s Tait, Parker, Carney & Goodman-Delahunty]; (3) ‘National registration of health practitioners: a comparative study of the complaints and notification system under the national system and in NSW’. He continues to supervise doctoral students, and in 2005 he was the recipient of the University of Sydney Vice Chancellor’s Award for Excellence in Higher Degree Supervision.
Professor Carney has chaired various Government enquiries (including Victorian enquiries on Child Welfare Practice and Legislation (1982-84), on Health Law (1986-1987)) and was a member of Australia's pioneering enquiry into Adult guardianship (1980-1982). He oversaw the writing of the Social Security Act 1991 (Cth) and is the longest serving member of the Social Security Appeals Tribunal. He was also a founding Director of the National Children and Youth Law Centre (1992-2003).
