Professor Barbara McDonald comments on the negligence case against the New South Wales and ACT Governments by 120 victims of the 2003 Canberra bushfires.

In an interview on ABC Radio Current Affairs program, AM, Professor McDonald says it's not clear in Australian law whether fire authorities have a duty of care to individuals.
"However, I think if the plaintiffs win it will be an important example of a case where plaintiffs have succeeded against a public body; they are not very common.

"If the plaintiffs lose, it will just really reinforce the difficulty and reinforce the fact that it is very difficult to succeed."
