The limits of the Independent Commission Against Corruption (ICAC)

23 November 2010

Associate Professor Anne Twomey says the ICAC is unlikely to pursue charges against Federal Independent MP, Rob Oakeshott.

The Federal Coalition has made two separate referrals to the Independent Commission Against Corruption (ICAC) in relation to a company that was a major donor to his campaigns as State MP for Port Macquarie and Federal MP for Lyne respectively.

In an interview with The Australian, Associate Professor Twomey asserts that while there would be no obstacles to the ICAC investigating Mr Oakeshott's conduct as a state MP in 2006, the federal matter fell outside the jurisdiction of the ICAC.

"The ICAC act is directed at state officials, MPs and ministers of the crown.

"I don't see how the act could apply to this."
