Sharia Family Law

28 June 2012

Dr Ghena Krayem comments on the move by legal assistance organisations to blend sharia divorce law with the Australian family law system.

A report in today's The Australian states that organisations including Legal Aid NSW and CatholicCare, have been training family law mediators to work with members of the Muslim community to help deliver out-of-court divorce settlements for Muslims.

Dr Krayem says she is in favour of harmonising Australian and sharia family law.

"If there is a power imbalance, then the mediator is there to address that. If they can't address that then it's actually not suitable for family dispute resolution and it will continue on its way to court," she asserts.
