Advanced Evidence - LAWS3406

This unit builds on knowledge gained in the compulsory course Evidence. We conduct a close and interdisciplinary examination of a variety of rules of evidence. This will give students an appreciation of the goals of evidence law - which include factual accuracy, efficiency, and respecting institutional values such as democracy and human rights - and how well these goals are achieved. As well as adopting legal perspectives we will consider the psychology and logic of proof, and the sociological place of law and the trial. As well as taking a close more critical look at some of the evidence principles covered in compulsory evidence we may consider new topics such as identification evidence and evidence of past sexual history. Australian law may be compared with law of other jurisdictions. The seminars will be interactive, with room for student presentations, discussion and group work as the sheer transmission of information.

Class participation (5%); short presentation (of prescribed text) (10%); long presentation (work-in-progress on research essay) (20%); 4000wd research essay (65%)
