State and Territory requirements

Information for patients and medical professionals

Each Australian State and Territory has varying requirements for patients accessing medicinal cannabis.

State and territory requirements vary depending on the medicinal cannabis product. For example preparations containing 98% cannabidiol (CBD) and no more than 2% of other cannabinoids are 'Schedule 4' medicines (Prescription Only) which do not require state or territory authorisation, with the exception of Queensland and Tasmania. Most other medicinal cannabis products fall under 'Schedule 8' (Controlled Drug) all of which require state and territory approval.

Australian Capital Territory

Who can apply? Specialists only. General practitioners may apply but require specialist support (SAS Category B only). 

Information on state/territory requirements: You must have authority to prescribe through one of the TGA schemes first before you apply to the ACT CHO for approval.

New South Wales

Victoria

Who can apply? Applications by specialists are generally restricted to paediatricians for intractable epilepsy. At present, general practitioners are not authorised to apply unless there are exceptional circumstances.

Northern Territory

Who can apply? Specialists only. GPs can assist specialist with ongoing prescriptions.

Prescribers who have obtained authority from the TGA and are treating a patient for two months or more must also comply with the 'Notification' requirement to the NT Chief Health Officer. Download the NT 'Notification' Form.


Queensland

Who can apply? Only specialists can apply to be a patient-class prescriber. Both specialists and general practitioners can apply to be a single-patient prescriber.
