The content of this unit of study will be the following topics: Economic Theory of Competition Law; the Concepts of competition, market definition, market power, substantial lessening of competition and public benefit; Part IV: Cartels - Civil and Criminal Prohibitions; Section 45 Contracts, Arrangements and Understandings; Section 46 Misuse of Market Power; Section 47 Exclusive Dealing; Section 48 Resale Price Maintenance; Section 50 Mergers; Part IIIA Access to Services; Part VI Remedies and Enforcement; Part VII Authorisations and Notifications. The intended outcomes for students who successfully complete this unit are that they will have a firm grasp of the operation of the competition law provisions of the Competition and Consumer Act 2010. Assessment summary

  • Research Essay (40%): Students are required to create a 4000 word, excluding footnotes and referencing research essay responding to a research topic released via Canvas at 10:00AM (Sydney Australia time) on 27 August 2024.    The essay will be on a significant topic covered in the unit and will require in-depth research of the topic and subsidiary issues within that topic. The research essay is due at 4:00PM (Sydney Australia time) on 8 October 2024 and must be submitted via Canvas. Marking criteria and additional information will be provided in class/via Canvas.
  • Final Exam (60%): Students are required to sit the final exam. The exam will require students to answer three [3] of a possible five [5] problem questions that address the content covered by the entirety of the unit. All answers should be of approximately equal length. The exam will be held on-campus and supervised during the formal exam period in November 2024 and is paper-based. The exam will be 2.5 hours of writing time plus 30 minutes of reading time to prepare your responses. If a student is absent from the final exam, a successful grant of Special Consideration will be a replacement exam in the first instance.

By writing a research essay and completing the final exam, students are demonstrating their understanding of and ability to interpret the fundamental concepts of competition law (ULO1) in the context of contemporary debates in competition law and the implementation of the Competition and Consumer Act 2010 (Cth) and other relevant legislation by the ACCC, Courts, and Tribunals (UO2). In demonstrating this, students will have to draw on their research (ULO4) and communicate logical arguments addressing complex competition scenarios (ULO3 and ULO5).

Word limit penalty: A piece of assessment that exceeds the prescribed word limit will attract a penalty of 10% of the total marks available for the piece of assessment for every 100 words, or part thereof. The total word count for essay and other written assessments will exclude all footnotes and any bibliography (if required). 

Use of editors or proof-readers: The use of assistance in preparing and editing assessment tasks in this unit of study is strictly prohibited. Assistance includes human and automated writing tools (not including spell checking). The use of Studiosity does not breach this rule but must be acknowledged. 

Special consideration: Successful grants of Special Consideration may involve alternative tasks, as appropriate. 

Assessment requirements to pass a unit of study: A student must make a genuine attempt at all assessment tasks set out in this Unit of Study to obtain a Pass mark and grade (or above); otherwise an Absent Fail grade will be recorded as the student’s result for this Unit of Study.

Late submission

In accordance with University policy, these penalties apply when written work is submitted after 11:59pm on the due date:

  • Deduction of 5% of the maximum mark for each calendar day after the due date.
  • After ten calendar days late, a mark of zero will be awarded.

This unit has an exception to the standard University policy or supplementary information has been provided by the unit coordinator. This information is displayed below:

The late submission of a piece of assessment, without an approved extension, will attract a penalty of 10% of the total marks available for the piece of assessment per 24 hours or part thereof, after the due time on the due date. For example, a submission after 4pm but before the same time the following day will attract a 10% penalty. Late penalties do not apply to the final exam.

Academic integrity

Use of generative artificial intelligence (AI) and automated writing tools

You may only use generative AI and automated writing tools in assessment tasks if you are permitted to by your unit coordinator. If you do use these tools, you must acknowledge this in your work, either in a footnote or an acknowledgement section. The assessment instructions or unit outline will give guidance of the types of tools that are permitted and how the tools should be used.

Your final submitted work must be your own, original work. You must acknowledge any use of generative AI tools that have been used in the assessment, and any material that forms part of your submission must be appropriately referenced. For guidance on how to acknowledge the use of AI, please refer to the AI in Education Canvas site.

The unapproved use of these tools or unacknowledged use will be considered a breach of the Academic Integrity Policy and penalties may apply.

Simple extensions

If you encounter a problem submitting your work on time, you may be able to apply for an extension of five calendar days through a simple extension.  The application process will be different depending on the type of assessment and extensions cannot be granted for some assessment types like exams.

Special consideration

If exceptional circumstances mean you can’t complete an assessment, you need consideration for a longer period of time, or if you have essential commitments which impact your performance in an assessment, you may be eligible for special consideration or special arrangements.

Special consideration applications will not be affected by a simple extension application.

Attendance and class requirements

Attendance: All students are required to attend at least 70% of classes to satisfy the pass requirements for each unit of study. Failure to meet this requirement may result in a student being precluded from undertaking the final assessment.

Referencing: The Sydney Law School expects you to use the Australian Guide to Legal Citation (4th edition, 2018) for your footnoting style, although you should confirm this with your lecturer. Study commitment

Typically, there is a minimum expectation of 1.5-2 hours of student effort per week per credit point for units of study offered over a full semester. For a 6 credit point unit, this equates to roughly 120-150 hours of student effort in total.

  • LO1. identify and interpret the fundamental concepts of competition law, such as markets, competition, market power, substantial lessening of competition, and public benefit, to develop a nuanced understanding applicable to various legal scenarios.
  • LO2. analyse the contemporary debates on the regulation of economic activity by competition law, including how economic arguments are integrated within the Competition and Consumer Act 2010 (CCA) and other related legislation.
  • LO3. evaluate the implementation of competition laws by the ACCC, the Courts, and Tribunal(s), and apply insights from Part IV of the CCA and other relevant provisions (e.g., access and remedies) to complex factual situations.
  • LO4. independently apply relevant legal research methodologies to synthesise information from a range of primary and secondary sources (principles and rules, case law, legislation) covered in the unit, to undertake significant research in competition law.
  • LO5. communicate sound and logically-structured legal arguments in a coherent and persuasive manner via multiple media to diverse legal, business, and lay audiences.
