LAWS1021: Public Law

This unit of study is designed to introduce students to the principles and structures that underpin constitutional and administrative law in Australia. It is broader than either of these subjects because its focus is on generic issues of governance and accountability. The central theme of this unit is the accountability of government to the people, under the Australian constitutional system of representative and responsible government. The focus is on understanding the types of public power that exist under the Australian Constitution, identifying limits on those powers, the source/s of those limits and the legal avenues for challenging the purported exercise of those powers. We begin with an introduction to the Constitution, its history, and the structures established by it, together with consideration of how to change both State and Commonwealth Constitutions, and 'the people' in the constitutional system. The unit of study then moves to consider the three arms of government and related concepts. In relation to the legislature, the focus is on understanding the representative character of the Commonwealth parliament and parliamentary oversight of delegated legislation. The discussion of the executive focuses on the principles of responsible government and different forms of non-statutory executive power. After addressing the source and scope of the executive power, we then move to look at selected mechanisms for holding the executive to account: freedom of information; and integrity bodies. The consideration of judicial power focuses on the separation of judicial power and institutional integrity of the courts.

Assessment summary

  • Interim assessment (30%): The assignment will assess material covered in Topics 1-5. It will comprise a problem and a short essay/short answer. The word limit is 2,000 words (including references). The assignment will be released at 6pm Tuesday 30 August 2022 and is due 3pm on Friday 9 September 2022. No simple extensions will be given. 
  • Final exam (60%): The final exam will assess material covered in Topics 1-10 with a focus on Topics 6-10. The exam will comprise two problem questions. The word limit will be 3,000 words. The exam duration will be 3 hours plus 30 minutes reading time. There will also be a 15 minute upload time. 
  • Structured participation (10%): Each student will be rostered to one panel (3-6 students) which leads a 25-minute class discussion of an assigned sub-topic; guided by focus questions published on canvas at least 2 weeks prior. Panelists should divide the questions equitably, allowing each panelist 3 minutes speaking time to present necessary content, and their initial reaction, to facilitate class discussion. Panelists are assessed individually, on demonstrated understanding of the materials, preparation of a well-structured and clearly presented response to issue/s raised in the focus question/s, and engagement with the class.

As a general guide, a high distinction indicates work of an exceptional standard, a distinction a very high standard, a credit a good standard, and a pass an acceptable standard.

Late submission

In accordance with University policy, these penalties apply when written work is submitted after 11:59pm on the due date:

  • Deduction of 5% of the maximum mark for each calendar day after the due date.
  • After ten calendar days late, a mark of zero will be awarded.

This unit has an exception to the standard University policy or supplementary information has been provided by the unit coordinator. This information is displayed below:

Interim Assignment: The late submission of an assignment which has not been granted an extension will attract a penalty of 6 marks (20% of 30 marks) per 24-hours or part thereof. For example, a submission after 3.00pm but before the same time the following day will attract a 6 mark penalty. Late penalties will be strictly applied. The date and time of submission as recorded by Canvas is taken as the official and final record of a student’s submission. Final exam: Online exam deadlines are strictly applied. Late exam submissions will not be marked.

Academic integrity

The Current Student website provides information on academic integrity and the resources available to all students. The University expects students and staff to act ethically and honestly and will treat all allegations of academic integrity breaches seriously.

We use similarity detection software to detect potential instances of plagiarism or other forms of academic integrity breach. If such matches indicate evidence of plagiarism or other forms of academic integrity breaches, your teacher is required to report your work for further investigation.

Use of generative artificial intelligence (AI) and automated writing tools

You may only use generative AI and automated writing tools in assessment tasks if you are permitted to by your unit coordinator. If you do use these tools, you must acknowledge this in your work, either in a footnote or an acknowledgement section. The assessment instructions or unit outline will give guidance of the types of tools that are permitted and how the tools should be used.

Your final submitted work must be your own, original work. You must acknowledge any use of generative AI tools that have been used in the assessment, and any material that forms part of your submission must be appropriately referenced. For guidance on how to acknowledge the use of AI, please refer to the AI in Education Canvas site.

The unapproved use of these tools or unacknowledged use will be considered a breach of the Academic Integrity Policy and penalties may apply.

Outside assessment tasks, generative AI tools may be used to support your learning. The AI in Education Canvas site contains a number of productive ways that students are using AI to improve their learning.

Simple extensions

If you encounter a problem submitting your work on time, you may be able to apply for an extension of five calendar days through a simple extension.  The application process will be different depending on the type of assessment and extensions cannot be granted for some assessment types like exams.

Special consideration

If exceptional circumstances mean you can’t complete an assessment, you need consideration for a longer period of time, or if you have essential commitments which impact your performance in an assessment, you may be eligible for special consideration or special arrangements.

Special consideration applications will not be affected by a simple extension application.

Attendance and class requirements

Attendance: All students are required to attend 70% of classes to satisfy the pass requirements for each unit of study. Attendance requirements must be satisfied by either in-person or online attendance as per the delivery mode of the unit. Failure to meet this requirement may result in a student being precluded from sitting the final assessment.

Word count penalty: A piece of assessment which exceeds the prescribed word limit will not be read beyond the word limit. The total word count for essay and other written assessments will exclude: bibliography; footnote numbers; footnote citation; cover page – and include: body text; headings and sub-headings; quotations; anything other than numbers and citations in footnotes.

Study commitment

Typically, there is a minimum expectation of 1.5-2 hours of student effort per week per credit point for units of study offered over a full semester. For a 6 credit point unit, this equates to roughly 120-150 hours of student effort in total.
