LAWS6013: Advanced Employment Law

2025 unit information

This unit of study is designed especially for candidates in the MLLR program. The unit examines the regulation of the individual employment relationship. The unit builds on the introduction to this topic in the foundation LAWS6071 Labour Law unit, by examining in closer detail the formation, construction and interpretation of employment contracts (including incorporation of policies and other documents, and exercise of contractual discretions); duties of employers and employees in contract; termination of employment contracts; and post-employment obligations (including restraints of trade). At the completion of this unit, you should be able to:

  • LO1. demonstrate an understanding of the principles of contract law underpinning the regulation of employment relationships
  • LO2. recognise circumstances constituting a breach of an employment contract
  • LO3. demonstrate an understanding of a range of employer duties arising out of the employment relationship
  • LO4. understand the law regarding restraints of trade and the practical considerations in enforcing restraints
  • LO5. explain the principles governing the assessment of damages at common law, and the availability of equitable remedies.
