«p»«p»«p»Through an analysis of the exercise of litigation capability this thesis will inquire as to whether in the years 2019 to 2023 ASIC has demonstrated strengthened regulatory responsiveness and culture. In relation to court and administrative outcomes, investigations and use of investigation related powers ASIC makes public disclosures across its respective mandates about its enforcement activities to Parliament and public inquiries, through reporting and by issuing media releases. A comparison will be made between the representations ASIC's enforcement record and what the public record reveals about the enforcement priorities and practices employed and the outcomes achieved. Such comparison will be made with a view to drawing conclusions concerning regulatory responsiveness and culture and whether the progress made by ASIC since the Royal Commission is, or should be, sufficient for the maintenance of trust and confidence in the Australian financial system and whether any further reforms or improvements are necessary. «/p»«/p»«/p»
