Thesis title: ‘Corporate’ international crimes: the theory and practice of litigating business atrocities

Thesis abstract:

«p»This thesis investigates corporate accountability for international crimes by applying a single analytical framework that organises diverse and overlapping legal norms relevant to corporate accountability in national and international instruments for breaches of international criminal law. Through analysing the application of international law within nation-states’ domestic courts as the most appropriate forum (and with the exception of the African court of justice, the sole forum) for the enforcement of corporate misconduct, this thesis extracts and analyses comparative doctrinal responses to allegations of corporate wrongs across jurisdictions. It advances the argument that transnational international crimes often involve elements of state and corporate interoperability, and that a revised corporate governance model within states provides the best mechanism for the prevention and prosecution of international crimes within domestic courts. «/p»
